Terms of Service

Who you are contracting with

These terms are an agreement between you and Impera Manufacture GmbH, Albulastrasse 57, 8048 Zürich, Switzerland, registered in the Swiss commercial register under CHE-371.907.866, VAT CHE-371.907.866 MWST. We trade as PaymentCardDesign.com. In these terms, “we”, “us” and “our” mean Impera Manufacture GmbH, and “you” means the business or professional customer named in the order.

Business and professional customers

We sell to businesses and professional customers, including sole traders and founders setting up a business. We do not market to private consumers, and prices are shown excluding VAT on that basis. When you submit a brief you confirm separately that you are buying for business or professional purposes, and you separately ask us to begin work straight away and acknowledge that once the service has been fully performed you lose any right to cancel. We also ask for your VAT, UID or company registration number where you have one, so that we can invoice you correctly.

If it turns out that you are buying as a private consumer, nothing in these terms removes a right you have under the mandatory consumer law of the country where you live. Where you asked us to start work immediately and the service has been fully performed, any right to cancel ends on full performance. Where you cancel part way through, you pay a proportionate amount for the work already done. Please tell us before you order if you are buying privately, so we can price and document it correctly.

How a contract is formed

Everything on this website, including package descriptions and prices, is an invitation to make an offer. It is not an offer we are bound by.

When you complete the brief, accept these terms and pay, you are making an offer to buy the package you selected. Payment is taken at that point. You can review and correct everything you have entered before you submit.

A contract is formed when we send you an order confirmation by email. That email sets out the package, the card formats, the number of creative concepts and revision rounds, the fixed price and the target dates. Taking payment does not by itself form a contract.

We may decline any brief after payment has been taken. If we decline, we refund your payment in full within ten business days, no contract comes into existence, and no work is done. We may decline in particular where the brief falls outside our scope, where a requested date is not achievable, where an express request needs our approval and we do not give it, or where we are not able to work with the programme in question.

Services and packages

Services are provided as fixed-scope design packages. Core, Launch and Signature. The specific deliverables of each package are described at the point of purchase and form part of these terms.

Definitions

Revision exclusions

A revision round applies refinements within the agreed direction. The following are outside the scope of a revision round and, where you wish to proceed, require a separate quotation:

Delivery timing

Any delivery times we share are targets, not guarantees. Timelines depend on timely feedback, complete briefs and prompt provision of required materials.

Ownership

On final delivery and full payment, ownership of the bespoke designs we deliver to you transfers to you. This transfer expressly excludes:

These excluded items remain the property of their respective owners and are not transferred to you.

Our liability

There are limits we cannot set, and we do not try to. We remain fully liable for death or personal injury caused by us, for anything we do with unlawful intent, and for gross negligence. Swiss law does not allow those to be excluded in advance and nothing here attempts it. We also remain fully liable where liability is mandatory under applicable law.

Beyond that, and to the extent Swiss law permits:

You must notify us of any claim in writing within twelve months of the date we deliver the final files, describing the issue in enough detail for us to investigate it. This is a contractual notification requirement. It does not shorten any statutory limitation period, and nothing here attempts to alter one.

Showing your design as an example

You may grant us permission to show the finished design as an example of our work. Granting it reduces the price of your order by the portfolio discount shown at the time you order. Withholding it changes nothing else about the service.

Where you do not grant permission, everything you send us is treated as confidential by default: we do not show your design, publish it, or name you as a client.

No scheme approval

Final approval remains subject to the issuer, relevant card scheme, programme partners and selected manufacturer. Manufacturer-specific adaptation is not included unless separately agreed.

We do not claim or guarantee any Visa, Mastercard or other card-scheme approval or certification for the designs we deliver. Any such approval is the responsibility of the issuer, scheme, programme partners and manufacturer.

Manufacturing and production support

Manufacturer-specific adaptation, sourcing and production support are separate services. They are quotation-only and are not included in any design package unless separately agreed in writing.

Manufacturing is arranged in one of two ways, and we tell you which applies before you commit. Ordinarily we source and supply the cards ourselves:

We are not a card manufacturer, we do not operate a production line, and we are not a card issuer or a scheme member. Where we supply cards, they are produced by third-party manufacturers.

Governing law and jurisdiction

These terms, and any contract formed under them, are governed by the substantive law of Switzerland, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The courts at the registered seat of Impera Manufacture GmbH in Zürich, Switzerland have exclusive jurisdiction over any dispute arising out of or in connection with these terms. We remain entitled to apply to any competent court for interim or protective relief.
